The International Federation of Human Rights (FIDH) and its member organizations in Chile, the Corporation for the Promotion and Defense of the Rights of Pueblo (CODEPU) and the Observatorio Ciudadano, called the government and Congress to act on the demands of the Mapuche hunger strike and expressed their concern about the apparent unwillingness to Chile to meet these demands.
On 12 July a group of Mapuche began a hunger strike in the prisons of Conception and Temuco, which had joined other villagers in the prisons of Angol, Lebu and Valdivia in southern Chile. In total 32 people, including some complete 43 days of hunger strike liquid.
Among the demands made of the State found the end of the implementation of the antiterrorism law in cases involving them, in order to process some of them for military justice, a fair trial and the demilitarization of the Mapuche areas in which communities assert political and territorial rights.
Most people who are on strike today are formalized in a legal research and other prosecuted by the antiterrorism law. A group of them also had a double view, since the same actions are civil proceedings and the other in military justice.
To the President of the FIDH, Souhayr Belhassen, "The lack of response, so far, the Chilean authorities to the demands of the Mapuche hunger strike is very worrying, for the contempt which means for these people whose lives are in danger. This is in addition to the almost exclusive to the Mapuche in the antiterrorism law in the last decade, political crimes, is a measure of disproportion and discriminatory. And while there are facts that could crimes, the government's choice to endorse and even take part in proceedings under this law expresses a clear political will to repress social protest of the Mapuche population by means of the case, and have serious legal and social implications. "
FIDH For anti-terrorism law does not adequately ensure due process to allow the maintenance of secrecy of the investigation for long periods, to allow protection of witnesses that the defense does not know, giving rise to the existence of witnesses without face processes are still based on this law, to enable interception of communications of the accused that has included his lawyers; and preventing the implementation of precautionary measures other than detention. It has also been questioned by setting a high penalty, which doubled in several cases that established by ordinary legislation.
The application of this law also has social implications as it stigmatizes an already vulnerable population and their living conditions, and is subjected to a constant presence and vigilance of police in communities, which often has resulted in the disproportionate use of force against its members. This has caused serious psychological impact on them, which have been recognized by institutions of the state and agencies UNICEF as the situation of children.
The FIDH has said on other occasions to the authorities of Chile for his concern for the rights violations suffered by indigenous communities, particularly members of the Mapuche in the south of the country, which have led to arbitrary arrests, ill treatment, torture and death. The State has received repeated recommendations of treaty bodies, binding on Chile and the United Nations Special Rapporteur on indigenous peoples that demonstrate this critical human rights situation of the Mapuche people. Is the case with the recommendation of the Committee against Torture, which the state of Chile had meet last May, one of which insists on limiting the material and personal jurisdiction of the Code of Military Justice, to investigate and prosecute civil actions involving that has not been answered.
The State of Chile has expressed willingness to intervene in these matters and thus can be interpreted in the passage through parliament, where anti-terrorism law as the Military Justice Code have not been discussed. Also troubling is the government's insistence on implementing anti-terrorism legislation for various common subjects or social protests, increasing disproportionately their concept which leads to abuses and violations of human rights.
The FIDH and its member organizations in Chile, CODEPU and the Observatory, call the government to:

-seriously address the demands raised by the Mapuche prisoners to facilitate lay down their strike hunger:
-put an end to the terrorism law enforcement in cases involving them
-end processing of some of them by the military courts
-assure a fair trial
2 / In general:
-terrorism law reform, for violating the due process and ensure it is not applied for common crimes
-restrict the jurisdiction of military courts, so that they can not hear cases against civilians, and to ensure that all violations of human rights vested in the civil forum "demilitarize

-in general, correspond with its international commitments, in particular comply with the recommendations of the Committee against Torture and the Special Rapporteur on indigenous peoples of the UN.
