OPEN LETTER TO THE GOVERNMENT OF CHILE
ON THE STATUS OF 34 JAILED ACTIVISTS AND STRIKE MAPUCHES
HUNGER We, the undersigned deputies of the European Parliament, are deeply concerned about the health and lives of the 32 activists imprisoned Mapuche found on hunger strike since last July 12, 2010.
The territory of the Mapuche people, which more than 600,000 people is the largest indigenous group in Chile, is located in regions VIII, IX and X of southern Chile. As a result of a long history of marginalization, exclusion and discrimination, the Mapuche live in a situation of great social unrest. Moreover, they are covered by the so-called Anti-Terror Law and State Security, inherited from the era of the dictatorship and that they are confronted at once with proceedings before civilian courts and military courts, imposing double punishment.
understand the current hunger strike as a desperate cry for attention to a situation intolerable and contrary to international conventions on human rights. We share the opinion of the Human Rights Committee of the UN, that can not be judged as terrorists who participated in the protests. (18/05/2007)
In this context, in recent days we have followed with great interest and sympathy the news on the initiative of some members of Congress and representatives of the current government of Chile to launch a military justice reform and anti-terrorism laws on the eve of the bicentennial.
We therefore ask the Government of Chile, in this spirit, commitment to all efforts to find an immediate solution to the humanitarian situation critical of Mapuche political prisoners on hunger strike, as well as a solution long-term satisfactory to the social, economic, cultural and judicial Mapuche peoples. This would entail:
- Apply in letter and spirit of the Convention content 169 of the ILO, signed by the Republic of Chile;
- Forming a dialogue to listen to the demands of the Mapuche people and agree on durable solutions, particularly relating to constitutional recognition of their right to land and prior and informed consultation in cases of planned activities in its territory;
- demilitarize the regions inhabited by the Mapuche, not to criminalize the Mapuche communities and to refrain from repressive means, including for prisoners, such as isolation, dispersion and the relegation of Mapuche prisoners to detention facilities less accessible to families and lawyers;
- Ensure access for the Mapuche to the ordinary courts with all the procedural safeguards;
- Do not apply the system of double simultaneous trials in civilian courts and military, and therefore not applying the so-called Terrorism Act to the Mapuche detainees in acts of social protest and radical overhaul of the Code of Military Justice.
concerned organs of the United Nations has issued numerous recommendations to fully recognize the rights of indigenous peoples. The association agreement linking the EU and Chile and is based on a democratic clause and human rights as well as signs of some representatives of his government inspires confidence that the just demands of the Mapuche people will be answered in full agreement with these recommendations, most notably at this time, a few days of the Bicentennial festivities.
